Terms of Service

Please read these Terms of Service ("Terms") carefully before using myswingacademia.com, the MSA Hub, the Swing Trainer app, and related services (collectively, the "Services"), operated by My Swing Academia ("we," "us," "our").

1. Acceptance of Terms

By creating an account or using the Services, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Services.

2. Eligibility

You must be at least 13 years old to use the Services. If you are under 18, you confirm you have a parent or guardian's permission to use the Services.

3. Accounts

You are responsible for maintaining the confidentiality of your account and for all activity under it. Provide accurate information when creating your account.

4. Subscriptions & Payments

Some features require a paid subscription, billed through our payment processor (Stripe) on a recurring basis (monthly or annual, as selected) until cancelled. You can cancel anytime from your account settings; cancellation takes effect at the end of the current billing period. Fees are non-refundable except as required by law. Purchases made through a mobile app store are subject to that store's own payment and refund terms instead.

5. Physical Activity & Assumption of Risk

Swing Trainer and related training content involve physical dance training and exercise. You participate at your own risk. Consult a physician before beginning any new exercise program, especially if you have a pre-existing condition. My Swing Academia is not a medical provider and the Services do not constitute medical advice. To the fullest extent permitted by law, you assume all risk of injury arising from your use of the Services.

6. User Content

You retain ownership of content you submit (photos, videos, notes, messages, etc.). By submitting content, you grant us a license to host, store, and display it as needed to operate the Services. You're responsible for ensuring you have the rights to any content you upload and that it doesn't violate others' rights.

7. Acceptable Use

Don't use the Services to harass others, upload unlawful or infringing content, attempt to access accounts that aren't yours, or interfere with the Services' operation.

8. Coaching Features

Coaching features connect students and coaches for training purposes. My Swing Academia does not vet, certify, or guarantee the qualifications of coaches using the platform, and is not a party to any arrangement between a coach and student.

9. Third-Party Services

The Services may link to or integrate with third-party services (for example, Stripe, Discord, YouTube, Spotify). We aren't responsible for third-party content or practices; your use of those services is subject to their own terms.

10. Termination

We may suspend or terminate your access to the Services for violation of these Terms or for any reason, with or without notice.

11. Disclaimer of Warranties

The Services are provided "as is" without warranties of any kind, express or implied, to the fullest extent permitted by law.

12. Limitation of Liability

To the fullest extent permitted by law, My Swing Academia will not be liable for indirect, incidental, special, or consequential damages arising from your use of the Services.

13. Changes to These Terms

We may update these Terms from time to time. Continued use of the Services after changes take effect constitutes acceptance of the updated Terms.
